Terms of use

The website cinalto.mlhelvetic.swiss (the "Website") is run by ML Helvetic, Switzerland ("ML Helvetic", "we", "us"). Cinalto is the creative and marketing studio of ML Helvetic. By using the Website you accept these terms of use (the "Terms"). If you do not accept them, please do not use the Website. How we handle personal data is explained in our privacy policy.

These Terms cover the use of the Website only. Any work we do for a client is governed by a separate written agreement with that client, which prevails over these Terms.

1. Changes to these Terms. We may change these Terms at any time by publishing a new version on this page. The date above shows the latest version. If you keep using the Website after a change, the new version applies.

2. The Website. The Website presents Cinalto, its services and its work. We may change, suspend or remove any part of it at any time and do not promise that it will always be available or free of errors.

3. Information on the Website. The content of the Website is general information about our studio. It is not an offer that can be accepted. Prices, timelines and the scope of any work are agreed only in a written offer or contract.

4. Our work and intellectual property. The texts, pictures, films, logos, layout and code of the Website are protected by copyright and other rights. They belong to ML Helvetic or to the clients and partners for whom the work was made. Projects marked "Concept project, not commissioned" were made for brands we invented and do not show real companies. You may view the Website and share links to it. You may not copy, download (except files offered for download, such as those on our media kit page, under the rules stated there), change, republish or use its content for commercial purposes without our written permission.

5. Using the Website properly. You agree not to:

• use the Website in a way that breaks the law or the rights of others;
• try to gain access to parts of the Website or its servers that are not meant for you, or disrupt them;
• send automated requests in bulk, including through the demo form;
• send content through the form that is unlawful, misleading or harmful, or that contains malware;
• pretend to be someone else, or claim a link with Cinalto or ML Helvetic that does not exist.

6. Demo requests and messages. When you send a request through the "Book a demo" form or by email, you confirm that the information is accurate and that you may share it. A request does not create a contract. We will answer as soon as we can but do not have to accept any request.

7. Links to other websites. The Website may link to websites run by others. We do not control them and are not responsible for their content or their handling of personal data.

8. No warranty. We take care over the Website but provide it as it is. We give no warranty that its content is complete, accurate or up to date, or that it is free of viruses or other harmful components.

9. Liability. To the extent permitted by Swiss law, we exclude our liability for any damage arising from the use of the Website or from being unable to use it. This does not limit liability for damage caused intentionally or by gross negligence, or any other liability that cannot be excluded by law.

10. Applicable law and jurisdiction. These Terms are governed by Swiss law, without regard to its conflict-of-law rules. The courts at the registered seat of ML Helvetic in Switzerland have exclusive jurisdiction, subject to any mandatory place of jurisdiction provided by law.

11. Severability. If any part of these Terms is found invalid, the rest remains in force, and the invalid part is replaced by a valid rule that comes as close as possible to its purpose.
